Housing Code Abatement Board

Note: Files are reviewed and voted on by the Housing Abatement Board only. If you feel your property has been unjustly condemned, you may file a written request for a hearing before the city governing body. This appeal shall be filed within the 60 days from the receipt of the abatement letter. The appeal shall contain any objections to the findings by the Housing Code Abatement Board that the building is unsafe to the extent of creating a public nuisance. The appeal shall be submitted to the Building Department of the City of Phenix City. A hearing date will be held no less than 10, or more than 60, days after the request.

A five-person, regular-member board, comprised of members appointed by the Phenix City Council, have each been appointed to serve on the board for the term of the municipal appointing authority for two consecutive terms of office. All members of the board are citizens and residents of Phenix City.

Duties & Responsibilities

The Housing Abatement Board shall perform the duties delegated by the Code of Alabama, Section 11-53A-2. Whenever the board finds that any building, structure, part of a building or structure, party wall, or foundation situated in its jurisdiction is unsafe to the extent that it creates a public nuisance for any cause, it shall give notice to the person, firm, association, or corporation last assessed for state ad valorem taxes.
